Terms of Use for the VertexMD personal health record application.

Effective Date: February 16, 2026

These Terms of Use (“Terms”) govern your use of the VertexMD mobile application and related services (collectively, the “Service”).

By using VertexMD, you agree to these Terms. If you do not agree, do not use the Service.

Important: VertexMD is not a medical provider and does not provide medical advice, diagnosis, or treatment.


1) Eligibility and Account Context

  • You must be legally permitted to use the Service in your jurisdiction.
  • You are responsible for maintaining the confidentiality of your device and access controls.
  • You are responsible for the accuracy of information you enter.

2) Medical Disclaimer

  • VertexMD is an organizational and record-management tool.
  • Content in the app, including summaries and insights, is for informational purposes only.
  • Do not use VertexMD for emergency medical decisions.
  • In an emergency, call emergency services immediately.

3) Subscription Plans

VertexMD offers plan tiers, including:

  • Free
  • Pro
  • Family

Plan features and limits may change over time. Current plan details are shown in-app and in purchase screens.


4) Auto-Renewing Subscriptions (Apple)

If you purchase Pro or Family through Apple’s in-app purchase system:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel subscriptions in iOS Settings > Apple ID > Subscriptions.
  • Any free trial, if offered, is forfeited when you purchase a subscription where applicable.

5) Acceptable Use

You agree not to:

  • Misuse or interfere with the Service
  • Attempt unauthorized access to systems or data
  • Reverse engineer or abuse non-public APIs
  • Use the Service in violation of law

6) Privacy

Your use of VertexMD is also governed by the VertexMD Privacy Policy.


7) Intellectual Property

VertexMD, including software, branding, and content created by VertexMD, is protected by applicable intellectual property laws. These Terms do not grant ownership rights to you, except for the limited right to use the Service under these Terms.


8) Service Availability and Changes

We may update, modify, suspend, or discontinue parts of the Service at any time, including features, limits, and pricing, to improve reliability, security, and compliance.


9) Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not warrant uninterrupted operation, complete accuracy, or error-free performance.


10) Limitation of Liability

To the maximum extent permitted by law, VertexMD and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill arising from use of the Service.


11) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for security, legal, or operational reasons.


12) Governing Law

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of California.


13) Changes to These Terms

We may update these Terms from time to time. We will update the effective date and provide notice where required.
